1. Introduction
Welcome to Sparkle.ly. By engaging our services, you agree to the following Terms and Conditions, which comply with Ohio state laws, including the Ohio Consumer Sales Practices Act (CSPA).
2. Services Provided
Sparkle.ly offers the following services:

Seasonal Holiday Lighting Installation & Removal

Permanent Holiday & Accent Lighting Installation

Maintenance of installed lighting during the display period
All lighting equipment, cords, and mounting materials provided as part of seasonal services remain the property of Sparkle.ly under a lease program.
3. Scheduling and Cancellations

Appointments can be scheduled via our website or by contacting our office.

Cancellations must be made at least 7 days in advance of scheduled installation.

Cancellations made less than 7 days before installation may incur a cancellation fee up to $250.
4. Customer Responsibilities
Customers are responsible for:

Ensuring all exterior electrical outlets used for lighting are safe, weatherproof, and functional. Sparkle.ly is not liable for any electrical issues resulting from unsealed or faulty outlets.

Providing clear access to installation areas.
-
Ensuring pets are secured and children are supervised during service.

Verifying their electrical system can support the lighting installation.
5. Liability and Property Protection
Sparkle.ly is insured and will take reasonable precautions to prevent damage. However, Sparkle.ly is not liable for:

Pre-existing deterioration (e.g., cracked gutters, loose shingles, worn siding).

Improper or aged installation of outlets, gutters, roofing, or fixtures.
-
Acts of nature or force majeure (storms, wind, ice, etc.).
-
Vegetation damage resulting from installation/removal or incidental runoff.
-
Any damages caused by customer-provided or third-party-installed equipment.
6. Ownership of Lights and Materials

Seasonal holiday lights, extension cords, and mounting materials are leased to the customer for the duration of the season. Ownership remains with Sparkle.ly.

Permanent lighting systems purchased from Sparkle.ly will include manufacturer warranties where applicable.
7. Installation and Removal

Seasonal lights will be installed as agreed and removed after the holiday season, typically in January (unless otherwise specified).

Permanent lights are installed for year-round use and are not removed seasonally.
-
Weather conditions may affect installation or removal dates.
8. Maintenance and Service Calls

Sparkle.ly provides maintenance for seasonal displays during the contracted display period at no additional charge.

For permanent systems, warranty and service terms will apply as outlined in the installation agreement.
9. Payment Terms

Deposits are required to secure installation dates. Balances are due upon completion of installation unless otherwise agreed in writing.

Late payments may be subject to a $50 late fee for every 7 days past due, not to exceed the maximum permitted by Ohio law.

Sparkle.ly reserves the right to withhold removal or service for unpaid accounts.
10. SMS Communication Consent
By providing your phone number, you consent to receive SMS communications from Sparkle.ly, including scheduling updates, service reminders, and special offers. Message and data rates may apply. Text HELP for support or STOP to unsubscribe.
11. Right to Cancel
Under Ohio law, you may have the right to cancel certain contracts within a specific period. For example, contracts signed at your residence may be canceled within three business days. Please refer to the Ohio Attorney General’s website for more information.
12. Dispute Resolution
Any disputes will be governed by Ohio law. If not resolved amicably, disputes will be handled by the courts of Ohio.
13. Changes to Terms
Sparkle.ly reserves the right to modify these Terms and Conditions at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of the modified terms.
